Until West Virginia privatized the Workers’ Compensation system in 2006, this firm, particularly member Donald T. Caruth (1950-2010), regularly represented employers in Workers’ Compensation claims throughout Southern West Virginia. We were significantly involved in the development of benefit claims handling changes by the West Virginia Legislature in 2003 and 2005, which created the privatized Workers’ Compensation system in West Virginia and permitted private insurers to provide Workers’ Compensation coverage in West Virginia. This firm is one of the few firms in West Virginia selected to represent non self-insured employers throughout West Virginia during the 2 1/2 year transition period to a competitive, private insurance market, which began on July 1, 2008.
